AGB - SKI & SNOWBOARDSCHULE OSTTIROL

General

Unless expressly agreed otherwise, all agreements between the contractual partner and the SKI & SNOWBOARDSCHULE OSTTIROL are subject to the GTC of the owner. These include services such as giving ski and snowboard lessons, guiding and accompanying ski and snowboard tours, guided freeriding and training in avalanche and snow science.

Contract conclusion

Reservations for private courses, freeride courses and ski tours can be made by phone or via internet. Reservations are only considered firmly booked after written or verbal confirmation. All prices quoted by SKI & SNOWBOARDSCHULE OSTTIROL are in Euro. Price lists are without guarantee. We are not liable for printing errors.

Terms of payment

The ski course fee does not include the use of the lift facilities. The SKI & SNOWBOARDSCHULE OSTTIROL will not compensate for lesson times lost due to breakdowns of the cable car and lift facilities. The SKI & SNOWBOARDSCHULE OSTTIROL will invoice after the service has been rendered. Price refund due to injury or illness only with medical confirmation. Only unused days (difference) will be refunded. The SKI & SNOWBOARDSCHULE OSTTIROL does not charge sales tax according to § 6 UStG.

General terms

of participation

The contractual partner must inform the owner of the SKI & SNOWBOARD SCHOOL OSTTIROL about his abilities and experience before the start of the tour, as well as use equipment that corresponds to the state of skiing or snowboarding technology and the external conditions, which has been checked by a specialist company for function and safety (applies in particular to ski bindings). The contractual partner must also comprehensively inform the owner of SKI & SNOWBOARDSCHULE OSTTIROL about his/her physical abilities, health condition and any ailments prior to the start of the tour. Otherwise, the SKI & SNOWBOARDSCHULE OSTTIROL is entitled to terminate the contract. The contract partner has to follow the instructions of the owner. Failure to follow instructions entitles SKI & SNOWBOARDSCHULE OSTTIROL to immediate termination of the contract. Participation in events of the SKI & SNOWBOARDSCHULE OSTTIROL under the influence of alcohol or drugs entitles the holder to immediate termination of the contract. In the described cases of contract termination, the contract partner is not entitled to a refund of the fee paid.

Liability provisions

The SKI & SNOWBOARDSCHULE OSTTIROL acts as an organizer of ski school activities, freeride and ski tours. The SKI & SNOWBOARDSCHULE OSTTIROL is liable in accordance with the statutory provisions exclusively for damages that are directly related to the activities of the SKI & SNOWBOARDSCHULE OSTTIROL and that have been caused intentionally or by gross negligence. A corresponding liability insurance exists. The instructions of the owner are to be followed absolutely and exactly. A risk of injury cannot be completely excluded despite the most careful planning. With the participation it is acknowledged that a certain residual risk of injury can not be excluded, for which no liability is assumed on the part of the owner.

Warranty

Complaints are to be reported immediately to the SKI & SNOWBOARDSCHULE OSTTIROL by the contract partner so that remedial action can be taken. In case of non-notification, there is no right to a reduction of the fee. Claims against the SKI & SNOWBOARDSCHULE OSTTIROL must be asserted and substantiated in writing no later than 1 week after they arise.

Withdrawal

For all booked courses, a cancellation is possible up to 24 hours before the event without incurring a cancellation fee. If the cancellation is made at a later time, the SKI & SNOWBOARDSCHULE OSTTIROL is entitled to charge the agreed rate. Excluded are persons who can prove their inability to participate by a medical confirmation or due to a travel warning within 24 hours before the start of the event. If due to weather or avalanche conditions the execution of a tour cannot be guaranteed for safety reasons, the SKI & SNOWBOARDSCHULE OSTTIROL reserves the right to postpone a tour, to offer alternative offers or to cancel. Only in the event of a cancellation by the SKI & SNOWBOARDSCHULE OSTTIROL is the owner obligated to return the payment made. The contract partner is not entitled to any further claim.

Place of performance

The place of performance shall be the entire EU.

Place of jurisdiction

The court with subject-matter jurisdiction at the registered office of SKI & SNOWBOARDSCHULE OSTTIROL shall have exclusive jurisdiction to decide on all disputes arising from the contract. The language of the contract is German.

Choice of law

Austrian law shall apply. The CISG is excluded.

Legal validity

Should individual provisions of these contractual terms and conditions be invalid, this shall not affect the validity of the remaining provisions or that of the entire legal transaction. The ineffective condition shall be replaced by a condition that comes as close as possible to the ineffective condition in economic terms.

and trademark law

The copyright for published objects created by the author himself remains solely with the author of the pages. Any duplication or use of objects such as diagrams, sounds or texts in other electronic or printed publications is not permitted without the author's agreement. Photos and videos taken during the tour on the part of the SKI & SNOWBOARDSCHULE OSTTIROL can be used for public purposes (advertising, internet, etc.). The owner asks the contract partner to disclose, in case of possible violation of privacy.
